Thank you to all the winners and bidders! Online bidding has continued for
a select number of items that were not officially won on Saturday April 5.
Note: the closing date on these items is amended to July 15, 2008 and the minimum bid is the winning bid. The Terms
and Conditions for the continuing online auction will adhere to the Terms and
Conditions that were in effect at the Annual Conference wherever relevant.
I agree to the following terms and conditions.
ASLMS ONLINE
SILENT AUCTION TERMS AND CONDITIONS
Proceeds from this auction will be used to expand the Society’s research and
education programs and to make grants for research projects relating to the use
of lasers in medicine and surgery. The excess value of the bid over the item’s
assigned fair market value may be tax deductible. Please consult your tax
preparer.
ASLMS reserves the right to hold the bidding open for any item which does not
receive the minimum bid prior to the scheduled closing time of the Silent
Auction. If the bidding is held open on any item, the winning bid on that item
will then be the first bid that meets or exceeds the minimum bid, whether at the
Annual Conference or online after the Annual Conference. Only ASLMS members will
be eligible to bid online after the close of the Annual Conference.
ELIGIBILITY
You must be 21 years of age or more to bid. Any ASLMS member may participate in
the online bidding. Anyone attending the Annual Conference in Kissimmee may
participate in the final round of the Silent Auction. You must be a physician to
bid on lasers.
TERMS AND CONDITIONS
1) Participating in the auction constitutes acceptance of the Terms and
Conditions of this auction.
2) Online bidding ends at midnight CST, April 2, 2008. The ASLMS can not be held
responsible for server down time, or a bidder’s inability to access our website
which may affect timely submission of bids. Bidding will resume live at the
Silent Auction at our Annual Conference in Kissimmee at 5:30 p.m. on Thursday,
April 3, 2008 and continue until 7:00 p.m. on Saturday, April 5, 2008. Bid
forms, requirements, and deadlines for the final round of bidding at the Silent
Auction will be available at the Annual Conference in Kissimmee.
3) The final, confirmed online bid on each item will be the opening bid when the
Silent Auction opens in Kissimmee but not necessarily the winning bid for that
item. Attendees at the conference will be able to continue bidding on the item
in person at the Silent Auction. ASLMS reserves the right to request from a
bidder confirmation of available funds, such as a bank letter of credit, to
support the validity of any bid.
4) The winning bid on each item will be determined by the highest bid received
whether online or at the Silent Auction in Kissimmee. Winning bids will be
announced in the Exhibit Hall in Kissimmee following the close of the Silent
Auction at 7:15 p.m. on April 5.
5) By placing a bid, you are making a legally binding and irrevocable agreement
to purchase the item at a price equal to your bid. If your bid is the high bid,
you are legally obligated to purchase the item at that price, and pay shipping
and handling costs and any use tax due to the state in which the item will be
used.
6) Winning bidders must arrange for payment by reporting to the ASLMS
registration desk on-site in Kissimmee immediately following the close of the
auction or by contacting the ASLMS Central Office by email (information@aslms.org),
by telephone (715) 845-9283, or by fax (715) 848-2493 no later than 12:00 p.m.
CST Thursday, April 10, 2008, or, if bidding on an items is held open after the
close of the Annual Conference, within five days after being notified of having
submitted the winning bid. Staff will be available at the ASLMS registration
desk in Kissimmee until 9:00 p.m. on April 5, 2008. Winning online bidders will
be notified by an ASLMS staff member as soon as possible following conclusion of
the Silent Auction. Failure to make payment arrangements as required by this
paragraph will automatically disqualify the winning bid and the next highest
bidder will be declared the winner.
7) Acceptable methods of payment in U.S. currency include cash, or the purchase
price may be charged to the bidder’s personal or business Visa, MasterCard or
American Express credit card. After the conference, acceptable methods of
payment are cash, certified personal or company check, money order, or cashier’s
check payable to ASLMS, or the purchase price may be charged to the bidder’s
personal or business Visa, MasterCard or American Express credit card.
8) The winning bidder becomes the owner of the item at the close of the Silent
Auction, and from then on bears the risk of damage to or loss of the item. If
the winning bidder and the auction item are physically present at the Silent
Auction in Kissimmee, the winning bidder shall pay for and pick up their item at
the close of the auction.
9) ASLMS is unable to grant refunds or accept returns on these donated items.
DISCLAIMER
The items offered to you for purchase in this Silent Auction are provided by
third parties who are not affiliates of the American Society for Laser Medicine
and Surgery, Inc. (“ASLMS”). ASLMS has not inspected or determined the quality
or condition of any of the Silent Auction items, and makes no representation or
warranty with respect to those items, including without limitation warranties of
merchantability or fitness of the item for a particular purpose. Except for
warranties a manufacturer chooses to include, every item is being sold “As Is,
Where Is”. It is the bidder’s responsibility to determine the exact condition of
each item. The involvement of ASLMS in providing the product is limited to
offering donated products to bidders in its silent auction and ASLMS is in no
position to make any warranties of any kind. Warranties offered by the
manufacturer and made available to ASLMS by the donor are posted for your
reference. Bidders are advised to contact the manufacturer with any questions
related to the warranty.
